These Terms and Conditions (“Terms”) govern your use of montenegrodigitalnomadvisa.com (the “Site”) and the Montenegro Digital Nomad Visa consultation services (“Services”) provided by Adriacom Accountants D.O.O. (“we,” “us,” “our,” or “Adriacom”).

By using our Site or Services, you agree to these Terms. If you do not agree, please do not use our Site or Services.

1. Services Overview

Adriacom provides consultation and assistance services for Montenegro Digital Nomad Visa applications. Our services include:

  • Document review and preparation guidance
  • Application submission to Montenegro authorities
  • Communication with Montenegro Ministry of Internal Affairs (MUP)
  • Coordination of certified translations
  • Post-approval support and guidance

Important Notice

We are not a law firm and do not provide legal advice. We are a consultation service that assists with visa application processes. For legal advice regarding Montenegro immigration law, consult a licensed attorney.

We cannot guarantee visa approval. Final decisions on visa applications are made solely by the Montenegro Ministry of Internal Affairs. We assist with preparation and submission but cannot control the outcome.

2. Service Packages and Pricing

2.1 Service Tiers

We offer three service packages:

  • Document Review (€349): Document review and preparation guidance only. You submit documents yourself.
  • Full Service (€1,199): Complete application management including document review, submission, and Ministry communication.
  • Premium Package (€1,799): Full Service plus apartment search assistance and lease negotiation support.

2.2 Consultation Fee

Initial consultations are charged at €49 for 30 minutes. This fee is non-refundable and applies toward determining your eligibility and service needs.

2.3 Payment Terms

  • All fees are quoted in Euros (€) and must be paid before work begins
  • Payment is accepted via PayPal, bank transfer, or other approved methods
  • Prices are subject to change. Current pricing applies at time of booking
  • Service fees do not include government fees, translation costs, or notarization fees unless explicitly stated

2.4 Additional Costs

The following costs are not included in our service fees:

  • Montenegro government visa application fees
  • Certified translation fees (beyond what’s included in Premium package)
  • Notarization and apostille fees
  • Criminal background check fees from your home country
  • Health insurance premiums
  • Accommodation rental costs
  • Travel expenses to Montenegro

3. Client Responsibilities

3.1 Eligibility

You are responsible for ensuring you meet Montenegro’s eligibility requirements:

  • Non-EU/EEA/Swiss national
  • Minimum monthly income of €1,800 from remote work or self-employment
  • Valid passport with at least 6 months validity
  • Clean criminal record
  • Valid health insurance
  • Proof of accommodation in Montenegro

3.2 Document Provision

You must:

  • Provide complete, accurate, and truthful information and documents
  • Respond to requests for additional information within 7 business days
  • Obtain required documents (criminal checks, bank statements, etc.) in proper format
  • Notify us immediately of any changes to your situation

3.3 Communication

You agree to:

  • Maintain regular communication throughout the application process
  • Check your email regularly for updates and requests
  • Attend scheduled appointments (in-person or virtual) as required
  • Respond to Ministry requests promptly if contacted directly

4. Our Responsibilities and Limitations

4.1 What We Will Do

  • Review your documents for completeness and compliance
  • Provide guidance on Montenegro visa requirements
  • Submit your application to appropriate authorities (Full Service and Premium tiers)
  • Communicate with Montenegro MUP on your behalf (when authorized)
  • Provide status updates throughout the process
  • Offer post-approval guidance as specified in your service package

4.2 What We Cannot Do

  • Guarantee approval of your visa application
  • Control processing times (official estimate: 30-90 days, typically 45-60 days)
  • Change Montenegro government policies or requirements
  • Provide legal representation in disputes with authorities
  • Guarantee specific outcomes or timelines
  • Replace official legal advice from a licensed attorney

4.3 Timeline Estimates

Processing times are estimates based on typical cases:

  • Document review: 3-5 business days
  • Government processing: 45-60 days (actual times vary)
  • We are not responsible for delays caused by government processing, missing documents, or external factors

5. Refund Policy

5.1 Consultation Fee

The €49 consultation fee is non-refundable once the consultation has been scheduled, regardless of whether you attend.

5.2 Service Package Refunds

Before Work Begins:

  • Full refund available if requested before we begin document review
  • Request must be made in writing within 48 hours of payment

After Work Begins:

  • Partial refunds may be available based on work completed
  • No refund once application has been submitted to Montenegro authorities
  • No refund if application is rejected due to your ineligibility or incomplete/inaccurate information

5.3 No Refund Circumstances

No refund will be provided if:

  • Your visa application is rejected by Montenegro authorities
  • You become ineligible during the process
  • You fail to provide required documents or information
  • You miss appointments or deadlines
  • Government policies or requirements change
  • You change your mind after work has begun

6. Cancellation and Termination

6.1 Your Right to Cancel

You may cancel services at any time by providing written notice. Refunds (if any) will be calculated based on Section 5.

6.2 Our Right to Terminate

We reserve the right to terminate services if:

  • You provide false or misleading information
  • You fail to cooperate or provide required documents
  • You become ineligible for the visa
  • You breach these Terms
  • We determine we cannot effectively represent your case

In case of termination by us, we will provide a pro-rated refund for work not performed.

7. Confidentiality and Data Protection

7.1 Your Information

We treat your personal and application information as confidential and will:

  • Use your information only for visa application purposes
  • Share information only with Montenegro authorities and necessary service providers
  • Protect your data according to our Privacy Policy
  • Retain records as required by Montenegro law (typically 5 years)

7.2 Document Security

We implement security measures to protect your documents, but you acknowledge:

  • Email and internet transmission are not 100% secure
  • You should not send highly sensitive information (like passwords) via email
  • You are responsible for keeping copies of all documents you provide

8. Limitation of Liability

8.1 Service Limitations

To the maximum extent permitted by Montenegro law:

  • Our total liability to you is limited to the amount you paid for services
  • We are not liable for visa rejection, processing delays, or government decisions
  • We are not liable for consequential damages (lost income, travel expenses, etc.)
  • We are not liable for errors in information provided by you or third parties

8.2 Third-Party Services

We are not responsible for:

  • Errors by translators, notaries, or other service providers
  • Montenegro government processing errors or policy changes
  • Issues with accommodation providers or property owners
  • Payment processor fees or technical issues

8.3 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control, including:

  • Changes in Montenegro immigration law or policy
  • Government office closures or processing delays
  • Natural disasters, pandemics, or emergencies
  • Internet or technology failures

9. Intellectual Property

9.1 Site Content

All content on montenegrodigitalnomadvisa.com (text, images, logos, guides) is owned by Adriacom or licensed to us. You may not:

  • Copy, reproduce, or distribute our content without permission
  • Use our materials for commercial purposes
  • Remove copyright or proprietary notices

9.2 Your Documents

You retain ownership of all documents and information you provide to us. By using our services, you grant us permission to:

  • Use your documents for visa application purposes
  • Share them with Montenegro authorities and necessary service providers
  • Retain copies as required by law

10. Governing Law and Disputes

10.1 Applicable Law

These Terms are governed by the laws of Montenegro. Any disputes will be subject to the exclusive jurisdiction of courts in Bar, Montenegro.

10.2 Dispute Resolution

Before initiating legal action, you agree to:

  1. Contact us in writing to describe the issue
  2. Allow us 30 days to investigate and respond
  3. Attempt to resolve the matter through good-faith negotiation

10.3 Consumer Rights

If you are a consumer in the EU, you have additional rights under EU consumer protection law that cannot be limited by these Terms.

By using our services, you consent to receive communications from us electronically (email, website notifications). Electronic communications satisfy legal written notice requirements.

12.1 Acceptable Use

When using our Site, you agree not to:

These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and Adriacom regarding our Services and supersede any prior agreements or understandings.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

17. Assignment

You may not transfer or assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations to a successor or affiliate.
